Terms of Service

Welcome to ProductionPal. These Terms of Service (“Terms”) govern your access to and use of the productionpal.io website and the ProductionPal platform (the “Service”), operated by ProductionPal (“we”, “us”, or “our”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- “Account” means the user account you create to access the Service.
- “Company Workspace” means a shared workspace within the Service created by or for a legal entity.
- “Content” means any data, text, files, or materials you upload, create, or store through the Service.
- “User” or “you” means any individual who accesses or uses the Service.
2. Account Registration
- You must be at least 16 years old to create an account.
- You must provide accurate, complete information during registration and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
3. Use of the Service
Permitted use
The Service is designed for production companies, freelancers, and teams to manage productions, gear, crew, budgets, invoices, and related workflows. You may use the Service only for lawful purposes in accordance with these Terms.
Prohibited conduct
You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use automated means (bots, scrapers) to access the Service without our written consent.
- Upload malicious code, viruses, or harmful content.
- Resell, sublicense, or redistribute the Service without our written consent.
4. Your Content
- Ownership: you retain all rights to the Content you upload or create through the Service. We do not claim ownership of your Content.
- License: by using the Service, you grant us a limited, non-exclusive license to store, process, and display your Content solely to operate and improve the Service.
- No training: we do not use your Content to train machine-learning or artificial intelligence models.
- Responsibility: you are solely responsible for the accuracy, legality, and appropriateness of your Content.
5. Company Workspaces
When you create a Company Workspace, you represent that you have the authority to act on behalf of that entity. The workspace owner (admin) controls member access, roles, and permissions.
Data within a Company Workspace is shared among its members according to the access controls you configure. We are not responsible for how workspace members use the data you share with them.
6. Subscriptions and Payments
- Certain features of the Service may require a paid subscription. Pricing, billing cycles, and included features are described on our pricing page.
- Payments are processed by third-party providers (e.g., Stripe). By subscribing, you agree to the payment processor's terms.
- Subscriptions renew automatically unless you cancel before the end of the current billing period. You may cancel at any time from your account settings.
- Refunds are handled on a case-by-case basis. Contact us at [email protected] for refund requests.
7. Intellectual Property
The Service, including its design, source code, logos, and documentation, is owned by ProductionPal and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.
8. Availability and Support
- We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Planned maintenance windows will be communicated in advance where possible.
- Support is provided via email. Response times may vary depending on your subscription plan.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be error-free, secure, or available at all times.
11. Limitation of Liability
To the maximum extent permitted by applicable law, ProductionPal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless ProductionPal, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your Content, or your violation of these Terms.
13. Termination
- You may close your account at any time by contacting us or using the account settings in the Service.
- We may suspend or terminate your access to the Service if you violate these Terms or if required by law. We will provide reasonable notice where possible.
- Upon termination, your right to use the Service ceases immediately. We will retain or delete your data in accordance with our Privacy Policy and applicable law.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Denmark, without regard to conflict-of-law provisions. Any disputes shall be resolved in the courts of Copenhagen, Denmark.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
